KMCK Media – Terms of Service

These Terms of Service (“Terms”) apply to all galleries, downloads, products, and services delivered by KMCK Media(“we”, “us”, “our”) through Pixieset. By accessing or using any gallery or purchasing any product, you agree to these Terms.

1. Access to Galleries

Galleries may be password-protected or publicly available depending on the nature of the session.

You agree to:

• Keep any gallery password confidential

• Not share the gallery link or password without permission

• Use the gallery only for personal viewing and purchasing

Galleries may be removed or archived at any time at our discretion.

2. Ordering and Payments

All orders are processed securely through Stripe via Pixieset.

By placing an order, you acknowledge that:

• Prices are in NZD

• Payment must be completed before downloads or products are released

• KMCK Media does not store your payment card details

• You are responsible for providing accurate information at checkout

3. Digital Downloads

Digital products are delivered electronically.

• Downloads are available immediately after successful payment

• Some downloads may have expiration dates

• Once delivered, digital products cannot be exchanged or refunded

• You are responsible for saving and backing up your purchased files

4. Usage Rights & Licensing

All images and videos remain the copyright of KMCK Media.

Purchasing a digital file grants you a personal-use licence only, allowing:

• Personal printing

• Personal social media use

• Sharing with friends and family

You may not:

• Use the files for commercial or promotional purposes

• Sell or distribute the files

• Edit the images beyond basic cropping

• Submit the images to publications, competitions, or advertising

• Remove watermarks from preview or proofing images

• Train AI or create derivative content using the images

Commercial usage requires a separate licence.

5. Physical Products (If Offered)

For prints or physical goods:

• Colours may vary based on screen and printer calibration

• We are not responsible for incorrect selections made by you

• Damaged items must be reported within 48 hours with photos

• Delivery times vary depending on supplier and location

6. Gallery Privacy & Security

We take reasonable steps to protect your gallery and data, but:

• Online platforms can never be guaranteed 100% secure

• You are responsible for safeguarding links and passwords

• We are not liable for unauthorised access caused by sharing credentials

7. Refunds & Cancellations

Due to the digital nature of the products:

• All digital sales are final

• No refunds for change of mind or incorrect selections

For physical products, see the refund conditions in Section 5.

If an error is caused by us, we will correct or replace the affected product.

8. Service Availability

We may modify or discontinue parts of our service at any time, including but not limited to:

• Gallery availability

• Print options

• Download formats

• Hosting or technical integrations

Scheduled or emergency maintenance may temporarily affect access.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law:

• KMCK Media is not liable for loss of data, loss of profits, or consequential damages

• Our total liability in relation to any purchase is limited to the amount paid for that purchase
